1. Service Description

Fetching Company ("we", "us", "our") operates the fetching.company website and API (the "Service"). The Service extracts publicly available information from websites, including but not limited to logos, brand colors, fonts, contact information, social media links, and AI-generated descriptions.

2. No Warranty — "As Is" Basis

The Service and all data, content, and outputs provided through it are delivered on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise.

We expressly disclaim all warranties, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of accuracy, completeness, or reliability of any extracted data
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties that extracted data is correct, current, or complete
  • Warranties regarding the quality, accuracy, or usefulness of AI-generated content

This applies regardless of whether you use the Service under a free or paid plan.

3. AI-Generated Content Disclaimer

Parts of the Service use artificial intelligence (AI) models from third-party providers. You acknowledge and agree that:

  • AI-generated content may contain inaccuracies, errors, hallucinations, or misleading information
  • AI outputs should not be relied upon as factual or authoritative without independent verification
  • Confidence scores are estimates only
  • You are solely responsible for verifying and validating any AI-generated content

4. Data Accuracy & Completeness

The Service extracts data from publicly accessible websites using automated techniques. Due to the nature of web scraping:

  • Extracted data may be incomplete, outdated, or incorrect
  • Website changes may cause extraction to fail or return partial results
  • Contact information may be outdated or incorrectly parsed

You should always verify extracted data independently.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Fetching Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

Our total aggregate liability shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

6. Intellectual Property

We do not claim ownership of any logos, brand assets, or content extracted from third-party websites. All trademarks remain the property of their respective owners.

7. Credits, Payments & Refunds

  • Credits are consumed per API call, regardless of result quality
  • Monthly credits do not roll over
  • Purchased credit packs do not expire
  • Refunds are handled case-by-case

8. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Scrape for spam, phishing, or fraudulent purposes
  • Attempt to circumvent rate limits or access controls
  • Share, resell, or redistribute your API tokens

9. Third-Party Services

The Service relies on third-party providers including Cloudflare, Anthropic, OpenAI, and Stripe. We are not responsible for outages or limitations imposed by these providers.

10. Privacy & Data Processing

  • Account data: name, email address, hashed password
  • Usage data: API calls, URLs analyzed, timestamps, IP addresses
  • Payment data: processed by Stripe — we do not store credit card details

11. Modifications to Terms

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent courts in the Netherlands.
